Terms of Use

These terms govern your use of Mianote, the private daily journal made by MGem Labs for iPhone, iPad, and Mac. Please read them.

1. Acceptance

By downloading or using Mianote, you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the app. Your use of the App Store is also governed by Apple's standard Licensed Application End User License Agreement (EULA), which applies in addition to these terms.

2. Your license

We grant you a personal, non-exclusive, non-transferable, revocable license to use Mianote on devices you own or control, for your personal, non-commercial use, subject to these terms and the App Store rules. You may not copy, modify, reverse engineer, resell, or redistribute the app except as the law allows.

3. Your content

Everything you write in Mianote is yours. We claim no ownership over your entries, and because your content is end-to-end encrypted on your device, we cannot access it. You are responsible for your own content and for keeping your own backups, including by using the app's free export feature.

4. Subscriptions and purchases

Mianote offers a free trial, after which continued access is available through an auto-renewing subscription or a one-time Lifetime purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You manage and cancel subscriptions in your Apple ID settings; payment is charged to your Apple account. Except where required by law, payments are non-refundable; refund requests are handled by Apple. Prices may change, and we will give notice of changes as required.

5. Acceptable use

Use Mianote lawfully. Do not use it to break the law, infringe others' rights, or attempt to disrupt, attack, or gain unauthorized access to the app or its services.

6. Availability and changes to the app

We work to keep Mianote reliable, but we may update, change, or discontinue features over time. We are not responsible for losses arising from changes, maintenance, or interruptions to the app or any optional sync service.

7. Disclaimer

Mianote is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or that data will never be lost. Keep your own exports.

8. Limitation of liability

To the fullest extent permitted by law, MGem Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of Mianote. Where liability cannot be excluded, it is limited to the amount you paid for the app in the 12 months before the claim.

9. Changes to these terms

We may update these terms from time to time. We will revise the date above, and significant changes will be highlighted. Continued use after an update means you accept the revised terms.
